Personnel Security; Access Authorization Granted; Guideline I (Psychological Conditions)

September 17, 2021On September 17, 2021, an Administrative Judge determined that an individual's access authorization under 10 C.F.R. Part 710 should be granted. The Individual is employed by a DOE contractor in a position requiring that he hold a DOE security clearance. A DOE Contractor Psychologist had diagnosed the Individual with Bipolar Disorder with a current depressive episode. The Local Security Office notified the Individual that this diagnosis was the basis for a Security Concern under Guideline I.
During the hearing, the Individual presented evidence of his new treatment efforts and described various back up plans that he developed should he become unable to afford his current treatment plan. After reviewing the evidence and observing all of the testimony at the hearing, the Psychologist testified that the Individual's depressive episode was in remission and that he had a good prognosis. The Administrative Judge determined that the Individual resolved the security concern associated with Guideline I. Accordingly, she concluded that the Individual's access authorization should be granted. OHA Case No. PSH-21-0069 ( Kristin L. Martin).
