Personnel Security; Access Authorization Restored; Guideline I (Psychological Conditions)

April 13, 2021On April 13, 2021, an Administrative Judge determined that an individual's access authorization under 10 C.F.R. Part 710 should be restored. The individual is employed by a DOE contractor in a position that requires him to hold a DOE security clearance. In May 2017, the Individual disclosed that he was receiving treatment from a health care professional for a mental health condition. In July 2019, he underwent a psychological evaluation by a DOE consultant psychologist (Psychologist). The Psychologist diagnosed the Individual with Bipolar II Disorder and concluded his illness is not fully under control, which could significantly impair his judgment, stability, reliability, and trustworthiness. During the hearing, the Individual testified that he was actively in treatment with a psychiatrist and had been consistently taking his medication as prescribed. The Individual also testified to additional therapeutic tools that aid him in managing his Bipolar II Disorder, including his completion of a Dialectical Behavior Therapy program and two Intensive Outpatient Programs, his consistent psychotherapy sessions, his self-care practices, and his use of his support network. After reviewing the evidence and observing all the testimony at the hearing, the Psychologist testified that the Individual's Bipolar II Disorder was under full control and does not impair his judgment, reliability, and stability. The Administrative Judge determined that the Individual resolved the security concerns associated with Guideline I. Accordingly, she concluded that the Individual's access authorization should be restored. OHA Case No.PSH-21-0015 (Katie Quintana)
