January 22, 2019On January 22, 2019, an Administrative Judge issued a decision in which he determined that an Individual should not be granted access authorization. In a Notification Letter issued to the Individual, the DOE alleged the existence of derogatory information under Adjudicative Guideline F regarding his multiple delinquent debts, failure to file taxes for one year, and outstanding tax debt. The Notification Letter also alleged that the Individual had demonstrated a lack of candor in completing his Questionnaire for National Security Positions. After conducting a hearing, the Administrative Judge determined, among other things, that the Individual had neither resolved all of his delinquencies nor had he initiated a payment plan for his federal tax debt. He further determined that the Individual had not taken steps to correct his lack of candor and had, in fact, sought to justify his behavior. The Administrative Judge relied upon those findings to conclude that the Individual had not mitigated the concerns related to his finances or his trustworthiness, reliability, and judgment. Accordingly, the Administrative Judge found that the Individual should not be granted access authorization. OHA Case No. PSH-18-0071 (Richard A. Cronin, Jr).
