PSH-18-0032 - In the Matter of Personnel Security Hearing

An Administrative Judge (AJ) denied an Individual's request for a security clearance. The individual had intentionally provided false information during a Personnel Security Interview (PSI) concerning his alcohol use. Moreover the individual had a history of five alcohol related arrests including three DWIs. The Individual also stabbed his brother while under the influence of alcohol. In addition, the Individual has a history of several firings, including one position where he was fired for having three safety violations during a six-month period, and another position from which he was fired for forging a  document on his employer's Human Resources department letterhead to misstate his income downward in order to qualify for subsidized housing. A DOE Psychologist evaluated the Individual and diagnosed him with Substance Use Disorder- Alcohol, moderate and facets of Antisocial Personality Disorder.

At the hearing, the Psychologist testified that the Individual had achieved reformation from both disorders. The AJ found that the Individual had therefore resolved the security concerns arising under Guideline G and Guideline J, since he found that the individual's criminal activity was a symptom of his alcohol disorder since all of his criminal activities involved alcohol. However, the AJ further concluded that the Individual had not resolved the security concerns under Guideline E, or Guideline I.

Accordingly, the AJ denied the Individual's request for review. OHA Case No. PSH 18-0032 (Steven L. Fine).
