FIA-20-0014 - In the Matter of Al-Monitor, Inc.

On January 23, 2020, the Office of Hearings and Appeals (OHA) denied a Freedom of Information Act (FOIA) Appeal   filed by Al-Monitor, Inc. (Appellant) from a final determination issued by the Department of Energy's Office of Public Information (OPI). On Appeal, the Appellant alleged that OPI had improperly determined that the subject of its request was not a matter of current exigency to the American public. After review, OHA determined that the subject of the request was a niche interest and that a delay in processing would not pose a significant risk of harm to public debate on the issue.
