GC-52 provides legal advice to DOE on legal and regulatory requirements and standards for transportation of radioactive and hazardous materials. DOE has authority under the Atomic Energy Act of 1954 (AEA) to regulate activities related to the transportation of radioactive materials undertaken by DOE or on its behalf. DOE shipments generally are conducted in accordance with the requirements and standards of the Nuclear Regulatory Commission (NRC) and Department of Transportation (DOT) that apply to comparable commercial shipments, except where national security or another critical interest requires different action. GC-52 provides advice on the AEA, the Hazardous Materials Transportation Act, DOE, NRC and DOT regulations, DOE Orders and other directives, and other statutory and regulatory requirements relevant to transportation of radioactive and hazardous materials. GC-52 also provides advice on the applicability of state, local, and tribal laws, regulations, and agreements to DOE transportation activities.
