DOE found that several brands of general service lamps distributed by X-S Merchandise failed to comply with energy conservation standards.

DOE ordered X-S Merchandise, LLC (“X-S Merchandise”) to pay a $271,500 civil penalty after X-S Merchandise had manufactured and distributed in commerce in the U.S. multiple units of the noncompliant general service lamps. The Order adopted a Settlement Agreement, which reflected settlement terms between DOE and X-S Merchandise.


On November 30, 2023, DOE issued a Notice of Noncompliance Determination to X-S Merchandise finding that various models do not comply with applicable energy conservation standards based on DOE testing. X-S Merchandise provided DOE records showing the number of units X-S Merchandise distributed. Federal law subjects manufacturers and private labelers to civil penalties if those parties distribute in the U.S. products that do not meet applicable energy conservation standards.
