DOE ordered Whirlpool Corporation to pay a $1,901,540 civil penalty after Whirlpool had manufactured and distributed in commerce in the U.S. multiple units of the noncompliant Amana brand freezer basic model AQC0902DRW. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Whirlpool.
On January 6, 2017, DOE issued a Notice of Noncompliance Determination to Whirlpool finding that the Amana brand freezer basic model AQC0902DRW does not comply with applicable energy conservation standards based on DOE testing. Whirlpool provided DOE records showing the number of units Whirlpool distributed.
