On October 16, 2024, an Administrative Judge (AJ) determined that an Individual should not be granted access authorization under 10 C.F.R. Part 710. The DOE Local Security Office (LSO) discovered through the clearance application process that the Individual had significant history of criminal conduct that spanned approximately fourteen years between 2006 and 2022. Consequently, the LSO informed the Individual by letter that it possessed reliable information that created substantial doubt regarding his eligibility to possess a security clearance. At the conclusion of the hearing, the AJ determined that the LSO appropriately invoked Adjudicative Guideline (Guideline) J. The AJ also determined that the Individual did not put forth sufficient evidence to resolve the Guideline J security concerns.
