DOE found that Atlantic Tools rough service lamp model that bore a marking of “100 W” failed to comply with energy conservation standards.

DOE ordered Atlantic Tools Inc. (“Atlantic”) to pay a $5,000 civil penalty after Atlantic had manufactured and distributed in commerce in the U.S. multiple units of the noncompliant Atlantic Tools rough service lamp models that bore a marking of “100 W”. The Order adopted a Settlement Agreement, which reflected settlement terms between DOE and Atlantic.


On May 10, 2023, DOE issued a Notice of Noncompliance Determination to Atlantic finding that the Atlantic Tools rough service lamp models that bore a marking of “100 W” does not comply with applicable energy conservation standards based on the rated wattage greater than 40 watts. Atlantic provided DOE records showing the number of units Atlantic distributed. Federal law subjects manufacturers and private labelers to civil penalties if those parties distribute in the U.S. products that do not meet applicable energy conservation standards.
