On March 28, 2022, an Administrative Judge determined that an Individual's access authorization should not be restored under 10 C.F.R. Part 710. In August 2021, the Individual tested positive for marijuana metabolites on a random workplace drug screening. The Individual attributed the results of the drug test to a lotion he was given by his daughter, which he represented that he used for pain relief without knowing that it contained hemp. However, the Individual was unable to identify the product that he claimed to have used or prove that it was chemically possible for a topical lotion containing hemp to have caused the positive drug test. Therefore, the Administrative   Judge determined that the Individual had not resolved the security concerns under Guideline H and that his access authorization should not be restored.
