On April 16, 2018, the Office of Hearings and Appeals (OHA) denied a Freedom of Information Act (FOIA) Appeal filed by Actuation Test Equipment Company (Appellant) from a final determination issued by the Department of Energy's Bonneville Power Administration (BPA). On Appeal, the Appellant challenged BPA's determination, alleging that the requested documents were absent. After review, OHA determined that BPA conducted a search reasonably calculated to uncover the records requested by the Appellant and was under no obligation to create documents for the Appellant. Accordingly, OHA denied the Appeal. OHA Case No. FIA-18-0020.
